Enter Contest

GENERAL:

• This Contest shall be conducted by The Brick Warehouse LP (“The Brick”) South Edmonton Common Brick store at 1920 – 99 Street NW, Edmonton, AB for customers to enter. A customer is referred to as “You and “Your”.
• “Contest Period”: Store opening on July 27, 2021 – Store closing on August 4, 2021, MST

Ways to Enter during the Contest Period:

• To enter, You must live within the South Edmonton Brick Store postal code region and/or within one hundred (100) km of the Store address.
• If You make a purchase either a mattress set, mattress, or mattress and adjustable base (each combination will be referred to as “Mattress Purchase”) during the Contest Period, You will be automatically entered to win Your Mattress Purchase.
• No purchase is necessary in order to participate in this Contest. You will need to visit the store, “test drive” a new mattress and fill out a digital ballot that Your sales consultant will provide to You
• Draw Date: August 5, 2021 at 11:00 a.m. MST.

ELIGIBILITY:

• The contest is open to all residents of Alberta who have reached the age of 18, on or before Draw Date except employees of The Brick, and all people employed as contractors or sub-contractors of The Brick, and their immediate family members living in the same household.
• You agree to abide by the Rules as set out herein, subject to all federal, provincial, and municipal laws. It is a condition of eligibility that the winner authorizes The Brick to announce and publish his/her name, address and photograph, without remuneration or consideration, in any forthcoming publicity.

PRIZES:

There are Five (5) Mattress Purchases to be Won!

• The Win Your Mattress Purchase Winner will have the full price of their Mattress Purchase made between the Contest Period, including GST refunded to their original method of payment. The Brick will NOT refund any warranties, administration fees for deferring payment on Brick Desjardins Visa Card or delivery fees. If the Win Your Mattress Purchase Winner paid by cash, he/she will receive a cheque which will be issued from The Brick’s Corporate Office in Edmonton, Alberta. If the Win Your Mattress Purchase Winner paid by Brick card and has already paid the balance on their Brick card by the Draw Date, they will be refunded their Mattress Purchase price) by cheque.
• You win Your Mattress Purchase and return any component of it for any reason, the Prize, or any portion thereof, as determined by The Brick is required to be returned, You will be only eligible to receive a reselection of the returned piece -- no other compensation will be given.

No purchase necessary winner prize:

• If You entered the Contest by Digital Ballot and you are a Prize Winner, you may attend the South Edmonton Brick store location and choose a mattress, mattress set or mattress and adjustable base and The Brick will put $1,000 plus GST towards that purchase.
• The Brick’s Satisfaction Guarantee, Price Guarantee and Price Protection policies as published from time to time shall not be applicable for any mattress or mattress component. The Brick’s liability for defective merchandise shall be limited to repairing defective or, where appropriate, to exchanging such defective goods within the manufacturer’s warranty period and in accordance with such warranties. In no case shall The Brick refund or otherwise compensate the winner beyond repairing or exchanging defective goods.

DRAW PROCEDURES:

• On the Draw Date, a representative from The Brick’s corporate office will pull all Point-of-Sale sales data from the South Edmonton Common Brick store and all digital ballots submitted during the Contest Period and will make seven (7) random, computerized draws from all eligible entries to obtain five (5) Winners. The first five (5) Entries drawn will be the Eligible Winners. The other entries drawn will be back-up entries (“Alternate Winners”) in the event any Eligible Winner cannot be contacted or fails to complete the skill testing question
• A representative from Corporate Office will use his/her reasonable efforts to contact the Eligible Winners by phone or e-mail after the Draw Date. If an Eligible Winner cannot be reached by telephone or has not contacted The Brick within three (3) business days of The Brick leaving messages to do so (“Contact Date”), then that person will be disqualified and The Brick will contact the Alternate Winner until five (5) people have been confirmed as Prize Winners.

DECLARING WINNERS:

• Each Eligible Winner whose name has been selected on the Draw Date must:
1. Be over the age of majority in Alberta;
2. Within three (3) business days following the Contact Date, correctly answer a time-limited, arithmetical skill-testing question without the assistance of any person or mechanical/recording device(s)
   The skill-testing process shall be administered at a pre-arranged time and place;
3. Execute a declaration and release form confirming compliance with the Official Contest Rules and acceptance of the Prize; and
4. Should the Eligible Winner fail to answer the skill-testing question correctly or is unable to attend at the time and place designated by The Brick for the administration of same, that Eligible Winner shall be disqualified, and the skill-testing question shall be administered to the next Alternate Winner associated with their respective draw.
• An Eligible Winner whose name has been selected on the Draw Date must execute a declaration and release form confirming compliance with the Official Contest Rules and acceptance of the Prize.

ADDITIONAL TERMS:

• By participating, You agree that: a) these Official Contest Rules and The Brick’s records of the draw or any other aspect of this contest shall be final and conclusive in all respects; and b) release, discharge, indemnify and hold harmless The Brick and its trustees, directors, officers, and employees from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.

LIMITATION OF LIABILITY:

• The Brick shall not be responsible for print or typographical errors in any Contest-related materials; for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction, or mail that is not delivered due to any reason whatsoever. The Brick reserves the right to amend or vary the Official Contest Rules, including the imposition or addition of new rules which are deemed by The Brick in its sole discretion necessary for business efficacy.

PRIVACY POLICY:

• The Brick will use the contact information provided in contest entries for administration of this Contest and/or to ascertain your needs and market to You. We may communicate with You for any of these purposes by telephone, fax, text messaging, or other electronic means, and automatic dialing-announcing device, at the numbers you have provided us, or by internet, mail, email and other methods. By entering this Contest, You acknowledge and agree to give permission to The Brick to collect, use and disclose Your personal information in accordance with The Brick’s privacy policy (“Privacy Policy”). The Brick is committed to protecting the privacy of the personal information You have provided herein.
